Welcome to Dab Hand Marketing. By using our services, you agree to the following terms and conditions. Please read them carefully.
1.1 "Dab Hand Marketing" or "we" refers to the Australian sole trader business providing services as described in these terms and conditions.
1.2 "Client" or "you" refers to any individual or entity that has engaged Dab Hand Marketing for the provision of services.
1.3 "Services" refers to any work or tasks performed by Dab Hand Marketing for the Client, including but not limited to those listed in Section 2.
1.4 "Agreement" refers to the mutual understanding between Dab Hand Marketing and the Client, governed by these terms and conditions.
2. Our Services
Dab Hand Marketing provides a range of services including:
- Web development with Webflow and Shopify
- Graphic design
- Content marketing
- Paid ads
- Video production
- Membership sites
- Packaging design and branding
- Building chatbots
3. Formation of Agreement
3.1 The Agreement between Dab Hand Marketing and the Client is formed upon the Client's acceptance of a proposal, quote, or engagement of services provided by Dab Hand Marketing.
3.2 The Agreement shall be governed by these terms and conditions, any additional written agreements, and applicable laws and regulations.
4. Web Hosting
- Dab Hand Marketing cannot be held liable for any downtime, faults, missing data, or enquiry forms related to web hosting.
- We reserve the right to cancel plans due to non-payment.
- We operate on monthly and yearly plans. All invoices are expected to be paid in full within 7 days of receipt.
- Failure to pay may result in account suspension and subsequent deletion after 60 days.
4.3 Third-Party Hosts
We use various third-party hosts for our services, including:
- Webflow offers web design, development, and hosting services.
- Vercel provides deployment and hosting services for web applications.
- Netlify offers hosting and serverless backend services for web applications and static websites.
- Shopify provides e-commerce solutions and hosting services.
5. Copyright and Intellectual Property
5.1 Copyright Issues
- Dab Hand Marketing cannot be held liable for any copyright issues. This includes fonts, imagery, audio, video, or other copyrightable assets.
- It is your responsibility to ensure that all materials provided to us for use in your project are either owned by you or properly licensed.
5.2 Intellectual Property
- Unless otherwise agreed upon in writing, all intellectual property rights, including but not limited to copyrights, trademarks, and patents, in any work created or developed by Dab Hand Marketing for the Client shall remain the property of Dab Hand Marketing until full payment has been received for the provision of services.
- Upon receipt of full payment, Dab Hand Marketing hereby grants the Client a non-exclusive, perpetual, worldwide license to use, reproduce, and display the work created or developed as part of the services provided.
6. Additional Work and Charges
- Any additional work requested by the Client that is beyond the scope of the initial agreement will be billed at $100 AUD per hour.
7. Liability for Errors
- Dab Hand Marketing will not be held liable for any errors, including but not limited to spelling mistakes, incorrect contact information, or other errors.
- When we launch a site, it is assumed that you have checked it thoroughly and approved its content and functionality.
8. Third-Party Services
- Dab Hand Marketing cannot accept any responsibility for third-party services, applications, or other external factors that may impact the performance, reliability, or security of the work provided by Dab Hand Marketing.
9. Cancellation and Termination
- You may cancel your service with Dab Hand Marketing at any time, subject to any agreed-upon minimum contract term. Cancellation must be submitted in writing.
- In the event of cancellation or termination, all outstanding invoices must be paid in full.
- The Client agrees to indemnify and hold harmless Dab Hand Marketing, its officers, employees, agents, and subcontractors, from and against any claims, liabilities, damages, losses, and expenses, including but not limited to attorney's fees, arising out of or in connection with the Client's use of the services provided, the Client's violation of these terms and conditions, or the infringement by the Client, or any third party using the Client's account, of any intellectual property or other rights of any person or entity.
11. Limitation of Liability
- In no event shall Dab Hand Marketing be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from the provision of services or the use of any work created or developed by Dab Hand Marketing.
12. Changes to Terms and Conditions
- Dab Hand Marketing reserves the right to modify these terms and conditions at any time. Any changes will be posted on our website, and it is your responsibility to review them periodically.
13. Governing Law
- These terms and conditions shall be governed by and construed in accordance with the laws of Australia. Any disputes arising from these terms and conditions shall be exclusively subject to the jurisdiction of the courts of Australia.
